How to Protect Your Business From Personal Legal Trouble

Editor's Note: Learn from a panel of experts and entrepreneurs who have successfully financed their own ventures and are helping others do it at the Thought Leaders Live 2013 event May 29, in Long Beach, Calif. Event and ticket information can be found here.
Recently, I had a client get in a car accident that was clearly his fault. The other driver and passengers were seriously injured and the claims are going to be in the hundreds of thousands, if not millions. What makes the situation more precarious is that my client owns a successful business, a few rental properties and a personal home with equity in it. Regrettably, he and his wife had not taken steps to protect their wealth in the past because they didn't think something like this could happen to them.

10 Questions to Ask Before Naming Your Business

What's in a name? When deciding what to call your company, the answer is plenty. A business name can be too broad--or too confining. It can be too quirky--or not memorable enough. The challenge is to pick a name that's catchy, but also fits well with your particular type of business.
Here are 10 questions to ask as you ponder various names, keeping in mind that the choice could make all the difference in establishing your company in the marketplace.
What do I want a name to accomplish for my company?
A name can help separate you from competitors and reinforce your company's image, says Steve Manning, founder of Sausalito, Calif.-based Igor, a naming agency. He suggests clearly defining your brand positioning before choosing a name, as Apple did to differentiate itself from corporate sounding names like IBM and NEC. "They were looking for a name that supported a brand positioning strategy that was to be perceived as simple, warm, human, approachable and different," Manning says.

The Real Power of Health Insurance

As business owners, we tend to view health insurance as a nice perk to offer employees. But it's not a perk. It's a requirement for anyone choosing to go it alone as an entrepreneur.
One thing that people--and I'm one of them--seem to forget when it comes to moaning about the escalating cost of health insurance is that we're buying a safety net.
Other types of insurance help rebuild a house after a fire or buy a new car when the old one is demolished. But something strange happens to our interpretation of insurance when it comes to healthcare: We use it to pay for medical visits to deal with runny noses. This is akin to billing your auto insurance to fix a radiator hose.

The Pros and Cons of Franchising Your Business

Entrepreneurs who have developed a successful business often wonder if they should franchise as a way to expand their operations. Like any business model, franchising has its benefits and drawbacks.
There's no way to know for sure whether franchising is right for your company until you evaluate its pros and cons in the context of your operations. That usually requires the help of a franchise attorney or consultant, but before you start talking to the experts, you should get a sense of the key advantages and disadvantages.

The Next Real Estate Bubble Has Already Begun (But It’s Not What You Think)

    http://business.time.com/2013/05/23/the-next-real-estate-bubble-has-already-begun-but-its-not-what-you-think/?iid=biz-main-lead

The American public is, for obvious reasons, a bit gun-shy when it comes to asset bubbles. Ever since the financial crisis, market watchers have worried about bubbles in the stock market, in high yield debt, and even the reinflation of the real estate bubble. The latest asset class to receive worried attention from policy makers? Farmland.

Ultimate Guide to Groceries: 33 Tips That Will Help You Save

    http://www.savvysugar.com/How-Save-Groceries-29786000

    1. Buy in-season fruits and vegetables. Buying fruits and vegetables can get expensive, so to cut down on costs, it's important to buy ones that are in season because if they aren't, they can cost twice as much.
    2. Play with overage. According to one extreme couponer, some stores like Walmart give overage, which means that if "you have a coupon for $3 and your item is only $2, that extra dollar goes towards your other items." You can apply overage toward items that rarely have coupons, like meat and milk.

How Can I Prevent Another Denied Loan?

    Dear Debt Adviser,
I applied for a home equity line of credit with my mortgage lender. I was denied, in part, because I've been late occasionally on my mortgage payments. I now have a credit score of 670 and a high-interest auto loan for $5,400 that I'd like to pay off. Do you have any financial advice for someone like me? Please help!
    -- Sherry

    Dear Sherry,
One reason you were denied a home equity line of credit is because late mortgage payments put you in the category of a high-risk borrower. Your current credit score reflects that level of risk. Another reason you were denied is that you applied for a loan with the same lender using the same collateral.

How Grads Can Negotiate a Salary and Benefits Package

Salary negotiations are hard for even the most seasoned workers, but for college students fresh on the job market, the process can be intimidating. While talking about money can be uncomfortable, the discussion is necessary because it will determine grads’ starting income and potentially set the bar for future earnings.
According to NACE’s April 2013 salary survey, the average starting salary for the Class of 2013 stands at $44,928, rising 5.3% from the 2012 average salary of $42,666. Employers expect some level of discourse with candidates about salary and benefits during the hiring process, experts warn grads tread carefully and handle discussions with the utmost professionalism

You're Never too Young to Think About Your Estate

The last thing on the minds of young adults heading off to college is drafting a health care proxy and power of attorney. Once they emerge freshly educated four years later, visions of wills and trusts are also unlikely to be on their radar. After all, who thinks about ticking off items on an estate planning checklist while they're still in the throes of figuring out how they're going to pay off student loans?
Not many people do, but there are a few bare-bones estate planning basics that even the college freshman could benefit from and that are nearly necessities for singles in their 20s and 30s.

Older Workers Back in Demand as Employers Hunt for Experience

Workers across the board took a hit during the financial crisis and struggled to find work, but older candidates faced an even harder time regaining employment during and after the Great Recession. But that tide may be turning as employers are now looking to add older and more skilled workers to their payrolls.
“Experience has come back into vogue in a big way,” says Charles W. B. Wardell III, president and CEO of executive search firm Witt/Kieffer. “Management experience is beginning to be a real criterion.”
The economic downturn forced companies to do more with less on smaller budgets, which meant many people were promoted into management positions with little experience.  But a good worker doesn’t equate to an effective manager, and some promotions hurt office morale and led to high turnover.

Insurance That's 'Just Right' for an Old Car

Whether you drive an aging set of wheels because it's cheaper or because it has sentimental value, there are important things you need to know about buying insurance for an old car. In your auto insurance quote, you don't want to spend more on coverage than you need, but you also don't want to wind up without enough car insurance.
If you own a car that is getting on in years, you're not alone. Automotive research firm R.L. Polk & Co. reports that the average age of the more than 240 million cars and light trucks on U.S roads has climbed to a record 11.2 years. In 1995, the average age was 8.4 years. The recent recession has contributed to the trend of drivers keeping cars on the road longer..

Should You Change Your Maiden Name? 5 Things to Consider

    http://www.savvysugar.com/Should-You-Change-Your-Maiden-Name-30208048

Getting a ring on your finger doesn't just mean a fancy wedding; it also comes with big lifestyle changes. This includes the dilemma of whether or not you should change your maiden name. Before you make the plunge, keep these things in mind:
    • What to change it to: If you decide you want to change your name to reflect your new Mrs. status, keep in mind that there are plenty of choices. See this list for suggestions. You can do it the old-fashioned way and swap your last name for his, opt for a hyphenated hybrid of your last name and his, and more.
    • Your career: Is your full name synonymous with your career? Some women hang onto their maiden names because they've already established themselves in their field with their name. This is especially true for those who work in the media industry. They worry that changing their name may affect their advancement. Evaluate your priorities, and know that there are plenty of women who have changed their last names and continue to have successful careers, while there are plenty who are happy to have kept their maiden name.

They say talk is cheap, and that holds true when parents only discuss money in terms of spending with kids.
According to a new survey by T. Rowe Price, parents are talking to their kids about shopping, but are skipping conversations about household budgets, savings and financial goals. Close to 75% of survey respondents say they regularly have conversations with their kids about money, but the focus is on spending—not the family’s current financial situation.

13 Money Lies You Should Stop Telling Yourself By Age 40

Though most of today's workers have already accepted the fact that they'll work well past the age of 65, there's just something about that number -- 65 -- that still feels like an unofficial finish line. And by 40, the pressure really starts to hit home.

Half of workers said they aren't prepared for retirement in a 2013 Employee Benefit Research Institute report. Less than 20 years ago, that figure was only 27%.

Why An Irrevocable Trust Can Be Superior to Gifting

If you’ve heard of an irrevocable trust but don’t really understand them or what they are used for, you’re not alone. Most people have only heard one thing about these types of trusts: They’re set up by the rich as a way to give assets to their loved ones after they have passed.  However, only part of this popular belief is true.
Irrevocable Trusts are designed to allow a person’s estate to continue to be useful long after they pass away.  These trusts aren’t only beneficial for the Kennedy’s or the Rockefeller’s. Ordinary citizens have the ability to greatly benefit from these trusts as well, and with a little research and work, you may be able to do it without paying thousands of dollars in legal fees.

Apartment rents keep on rising in Los Angeles County

    http://www.latimes.com/business/money/la-fi-mo-la-apartment-rents-20130501,0,4811820.story

Rents in Hollywood have climbed in the last 12 months. Above, the Avenue apartment complex in Hollywood. (Francine Orr / Los Angeles Times / May 1, 2013)
Apartment vacancies plunged in Hollywood during the last 12 months and rents increased as the neighborhood continued to rebound from the recession. But vacancies were still more plentiful in the Santa Clarita Valley, where former renters bought low-priced homes.

Rents rose across most of Los Angeles County during that time as both blue- and white-collar companies added jobs at a faster pace than the national average, a report said. And landlords are expected to continue raising apartment rents in the months ahead, especially in neighborhoods where empty apartments are scarce.

How to Protect Your Personal Finances From Business Risks

One of the most misunderstood concepts in the law, especially for small business owners, is how to protect personal wealth. Many business owners get taken advantage of with high-priced asset protection plans that don't provide the protection they promise. Others avoid the topic and buy more insurance, crossing their fingers that an expensive lawsuit or accident doesn't befall them.

Part-timers to lose pay amid health act's new math

Some workers are having their hours cut so employers won't have to cover them under Obamacare. But many will benefit from the healthcare law's premium subsidies and Medicaid expansion.

Will ‘Sell in May’ Come True This Year?

It’s baseball season, so superstition is back in fashion in the stock market – not least, the old chestnut, “sell in May and go away!” And this little rhyme is not really like wearing the same socks to keep a win streak going; indeed, it’s all about knowing when to “fold” on the 2013 equity winning streak, take your cash and head to the beach. And there are even some statistics that bear out the claim that stock market returns in the May-September period do tend to run lower than over the remainder of the 12-month cycle commencing on May Day.

Why Your Credit Score Is So Bad

A Credit.com reader named Roger recently took me to task for my blog post, How to Decode Your Credit Score, that focused only on high credit scores and neglected some of the common reason codes that accompany lower credit scores:
What about reason codes: Serious delinquency and or public record or collection filed. Time since delinquency too short, or my favorite Number of delinquent accounts. OH Yeah, we are talking about how to decode your extremely high credit score…. I forgot.
My apologies go out to Roger and others who have some negatives on their credit report, as the reason codes they receive are just as important and can be just as confusing as the codes that come with the higher scores.

My Smartest Money Move: Taking More From My Retirement

We’re taught to think of retirement savings as a source of last resort — money that we shouldn’t touch until all other resources have been used up. However, given the way the tax rules work in combination with the nature of Social Security benefits, it can often be in your best interest to use your retirement savings (IRAs, 401(k) accounts, and the like) to allow you to delay and maximize your Social Security benefits. Below is a version of a situation that I recently worked through with a client.
