I advise all potential clients that they need to stop using all of their credit cards once they are seriously considering filing bankruptcy. The reason should be obvious: using credit cards when you are contemplating filing bankruptcy can be considered to be fraudulent and the creditor can object to the discharge of their particular debt that was incurred when you knew, or should have known, that you could not repay it.
If there is serious misuse of credit shortly before filing, you could also be in danger of losing your bankruptcy discharge, or have your case dismissed as an abusive bankruptcy.
Bankruptcy is a very powerful tool for the honest debtor. Don’t take the chance that you lose your ability to discharge your debt and obtain a fresh start after bankruptcy by being greedy or foolish – it can set up “red flags” in court case that can lead to a very unhappy result.
